  • On eve of health ruling, Ruth Bader Ginsburg predicts 'sharp disagreement'

    With a wry smile, Justice Ruth Bader Ginsburg laid waste Friday to all those rumors about the fate of the Affordable Care Act in the Supreme Court.

    “Those who know don’t talk. And those who talk don’t know,” she quipped Friday night at a conference hosted by the American Constitution Society at the Capital Hilton.

    Ginsburg said she was responding to a "steady stream of rumors and fifth-hand accounts" about the court's deliberations on the law.

    Careful not to tip her hand on the court’s ruling — expected in the next two weeks — Ginsburg described the oral arguments in the case as unprecedented for the number of “press conferences, prayer circles, protests and counterprotests” that occurred on the courthouse steps.

    Although she offered no insight into the tightly held decisions of her colleagues, Ginsburg did indicate that many of the court’s decisions over the next two weeks — which are also expected to include an FCC indecency ruling — might be close.

    The 21 remaining decisions, she said, were “many of the most controversial cases” that the court reviewed this term.

    “It is likely that the sharp disagreement rate will go up next week and the week after,” she said.

    Although the oral arguments on the ACA spanned six hours over three days, she noted that a case cited during those arguments — McCullough v. Maryland — featured oral arguments that spanned nine days over two months.

    Ginsburg noted that one ACA-related question the court must decide is whether the whole law must fall if the individual mandate is unconstitutional — “or may the mandate be chopped, like a head of broccoli, from the rest of it?”

    Is your favorite restaurant mistreating its workers?According to a guide released earlier this year by a group dedicated to workplace justice, some of the most popular fast-food, fine-dining, and family-friendly restaurants in the United States -- including McDonald's, The Capital Grille, and The Olive Garden -- are also the worst ones at which to work.

    "We all enjoy eating out," Restaurant Opportunities Centers (ROC) writes on the website for its National Diners' Guide 2012. "Unfortunately, the workers who cook, prepare, and serve our food suffer from poverty wages, no benefits like paid sick days, and little or no chance to move up to better positions. When the people who serve us food can't afford to pay the rent or take a day off when they're sick, our dining experience suffers."

    Ninety percent of the more than 4,300 restaurant workers surveyed by ROC reported their employers did not offer employees paid sick leave. Two-thirds of those surveyed reported that their employees routinely cook, prepare, and serve food while sick.

    Rich Jeffers, director of media relations for Darden Restaurants, owners of the Olive Garden,  the Capital Grille steakhouse, Longhorn Steakhouse, and Red Lobster -- all of which were called out in the survey over possible illegal practices because workers there have sought help for discrimination and wage theft -- said the organization never reached out to Darden about how employees are compensated before publishing its guide. He noted the average hourly wage with tips for the chain's wait staff is nearly $14.50, and the average hourly wage for a busser is $11. He took exception with a survey of 4,300 restaurant workers in an industry that employs 13 million people.

    Workers are entitled to a minimum wage of $7.25 per hour if they do not receive tips and $2.13 per hour if they do, as well as overtime pay, if they work more than 40 hours per week; if tips and wages don't add up to $7.25 per hour, the employer is obligated to make up the difference. But many workers aren't aware that they're entitled to payment for all of the hours they work, let alone at what rate, the guide noted. And a wage gap exists even among workers making the bare minimum that the government requires employers to pay. "Women, immigrants, and people of color hold lower-paying positions in the industry, and do not have many opportunities to move up the ladder," the report found. "Among the 4,300 workers surveyed, we found a $4 wage gap between white workers and workers of color, and 73 percent reported not receiving regular promotions on the job."

    The guide, which was published in January but gained some newfound attention this week when the New York Times' Mark Bittman and others wrote about it, ranked 150 of the most profitable restaurants in the United States on how much their workers earn, whether they get paid sick leave, and what kind of chances they have for advancement. Darden's Jeffers said 48.9 percent of its restaurant managers advance from entry-level positions, and that the company is keenly focused on upward mobility for its employees.

    A sizable number of well-known restaurant chains earned "zero" ratings because they didn't meet any of the minimum requirements for their workers -- and, contrary to what you might think, there are more than a few high-end fine-dining establishments on the list. Take a look:

    Jenny McCarthy gave a dentist something to smile about when she accidentally sent him a nude photo of herself (hey! it works). The former Playboy cover girl said she had snapped nude photos of herself meant for her boyfriend, Chicago Bears linebacker Brian Urlacher. But things went awry one morning when her 10-year-old son, Evan, woke up with a curious "thing" in his mouth, prompting her to send a photo of his mouth to the dentist.

    "So I'm taking a picture of it and I'm sending it to the dentist and I sent him a nude on accident! I swear to God!" McCarthy recalled.

    "The dentist is, like, 80 years old. I literally screamed at the top of my lungs."

    Last week, McCarthy told Howard Stern that son Evan, who has autism, misses ex-boyfriend Jim Carrey "almost weekly" and even attended therapy sessions as a result. McCarthy and Carrey split in 2010 after dating for more than five years.

    Bristol Palin Won't Rule Out Running For Office

    Bristol Palin weighed in on her political future on Thursday, telling Fox News' Sean Hannity that she wouldn't rule out the possibility of running for office one day.

    When asked by the Fox host if she would leave the door open to follow in her mother Sarah Palin's footsteps, Palin said she was too young to eliminate the possibility just yet.

    "I don't think I'd shut it completely yet," she said. "I'm only 21, but not any time soon."

    Palin declined to state whether or not her mother would decide to run for office again. However, she said, her family is well prepared for the trials of campaign life.

    "We all have tough skin. We're all strong. Our roots are very grounded," she said. "Whatever she does, we're going to support her."

    Palin appeared on Hannity's show to talk about her new reality show, "Life's a Tripp," which chronicles her life as a single mother. According to Palin, she agreed to document her life on camera with hopes of showing what her life is really like.

    "No matter what i'm doing, people are going to be talking about me," Palin, whose son Tripp will turn four this year. "I might as well have a platform and talk about things that are important to me, and show other girls that it's not easy."

    While Palin was not as critical of Tripp's father as she has been on other recent occasions, she did admit she was "sad that Tripp doesn't have an active father figure."

    Although the Lifetime series has yet to air, Palin has already expressed some regrets about how the show turned out.

    "If I would have known it was my own name and so much in my life is gonna be shown on this show, I think I would reconsider it and think about it more," Palin said of the series.

    More Women Were Likely Videotaped in Sears Dressing Room, Says Lawyer

    Female customers who shopped at a Sears store in North Hollywood, Calif., over the past three years may have been videotaped in the dressing rooms and restrooms, according to an attorney representing 25 women suing the retail chain.
    The group is suing Sears and a former maintenance worker who allegedly videotaped them from 2009 to April 2012.
    Michael Alder, the attorney for the plaintiffs, said an unknown number of female customers were also likely videotaped in the store during that period.
    "There's a lot of people who were patrons and don't have any idea that they've been videotaped," Alder said.
    Alejandro Gamiz, 27, a maintenance worker who worked at Sears for seven years, who is accused of placing hidden cameras behind the walls of the store. He was arrested on April 12 for burglary and surreptitious filming of unsuspecting women by North Hollywood Area Sexual Assault detectives. Gamiz posted $20,000 bail and was released from custody.
    The Los Angeles District Attorney's office is still reviewing the case and has not yet filed charges against Gamiz. Gamiz did not return a request for comment.
    Krystel Dean, an employee and one of the plaintiffs, said she was "shocked" when she learned of the secret videotaping.
    "My heart immediately sank," she said. "Not only have I used the restroom and dressing rooms, but my small children have used them as well. I feel like our privacy has been invaded."
    Dean is also suing Sears in the same suit for retaliation, saying her employer cut her work hours after she was the first to hire an attorney and speak to the media about the the alleged taping.
    Of the women filing the lawsuit against Sears, 16 are employees while the other nine are store customers who believe they may have been taped, including four children. The plaintiffs' last names, including Dean's, were not included in the lawsuit.
    The group filed a lawsuit against Sears on June 11 in the Los Angeles Superior Court, asking for unspecified compensatory and punitive damages for unpaid wages, mental and emotional distress, and attorney fees and costs, among other damages.
    The plaintiffs said Sears knew or should have known that Gamiz had installed video equipment and created peep holes within the three years he had set up the equipment. They are suing Sears for invasion of privacy, intentional infliction of emotional distress, hostile work environment harassment, and negligent hiring, supervision, retention, among other charges.
    Alder has invited other female patrons or employees who were in the dressing rooms or bathroom of the North Hollywood store in the three years before Gamiz was arrested to contact his law firm and visit the special website his law firm has established, SearsPeepingTom.com.
    "As information gets out, they will realize they frequented that Sears for the last three years and undressed," he said.
    Kimberly Freely, spokeswoman for Sears Holding Corp., said the company could not comment because the litigation is pending.
    "But as we said previously, and with all due respect to the associates who may have been impacted by this incident, no member of management or leadership in the company had any prior knowledge of the accused's alleged conduct until it was discovered in our store," she said. "At that point, we immediately launched an investigation and turned the matter over to the police."
    The lawsuit states that Gamiz created "peep holes" in women's restrooms and dressing rooms, and children's dressing rooms too. He then installed video equipment to record the women and children. He uploaded some of the videos to the Internet, according to the lawsuit, on a site that police have since been taken down.

    Bhanwari Devi case accused flees from police custody

     A man, accused in the Bhanwari Devi murder case, escaped from the police custody after a shoot-out between his accomplices and policemen at a court in Rajasthan’s Jodhpur city Thursday. Another accused was re-captured.

    The accused, Kailash Jhakhar, had been brought to the district and sessions court for a hearing of another case related to some land deals few years back, they added.

    Jakhar is accused of disposing the remains of nurse Bhanwari Devi who was abducted and then murdered Sep 1 last year at the alleged behest of sacked state minister Mahipal Maderna and Congress legislator Malkhan Singh Bishnoi.

    The Central Bureawu of Investigation (CBI) had arrested Maderna and Bishnoi in the case. It is alleged that Maderna and Bishnoi were being blackmailed by the nurse on the basis of sex CDs showing them in a compromising position with the nurse.

    “Some undertrials including two Bhanwari Devi murder case accused – Bishna Ram Bishnoi and Jhakhar – had been brought to the court for hearing in another case related to firing. Jhakhar is a member of Bishna Ram Bisnnoi’s gang,” a police officer told IANS.

    He added that a ground of about a dozen criminals was already inside the court premises.
    “They were armed. As soon as Jhakar and Bishna Ram got off the police vehicle, the criminals opened fire in the air to scare away the policemen. While Jakhar and all the attackers managed to escape, Bishnoi was caught on the spot,” said the officer.

    Officials said that a massive search operation has been launched to locate Jakhar.
    Bhanwari Devi had allegedly been kidnapped by three men – Shahabuddin, Baldev Jat alias Balia and Sohan Lal. As per the CBI chargesheet filed in a court, the trio murdered the nurse and then handed over her body to Bishna Ram Bishnoi and Jakhar who brunt her to ashes and dumped her remains in a canal in Jodhpur.

    Armed assailants descend on court, free Bhanwari case accused

    In a daring act, a group of assailants freed Kailash Jakhar, one of the accused in the Bhanwari Devi murder case, from police custody outside the District and Sessions Court in Jodhpur on Thursday. They also tried to snatch away one of the main accused, Bishnaram Bishnoi, after opening fire in the air but police foiled them. The cops arrested one Hanumanaram Vishnoi in connection with the incident and are questioning him to find out the whereabouts of the escaped prisoner and those who freed him. No one was seriously injured though one person was hit by a pellet apparently fired from a country-made pistol. The assailants also carried a sophisticated weapon which, onlookers said, looked more like an AK-47. Jodhpur's Commissioner of Police Bhupendra Dak blamed the jail authorities for ignoring the advice given by the police for extra precautions such as hand-cuffing while taking out those arrested in the case. However, the jail authorities pointed out that hand-cuffing was possible only if the court allowed it. The incident happened around 10.45 a.m. when both Jakhar and Bishnoi were being escorted out of the court by guards of the Jodhpur Central jail after presenting them in another case. The assailants reportedly more than a dozen, came in three vehicles — Bolero, Scorpio and Swift Desire — and started firing in the air to distract the police and scare away the litigants present. While Jakhar managed to flee, Bishnaram could not as one of the constables held on to him. Bishnaram again tried to escape in one of the vehicles the assailants had brought but the police managed to pull out the key from it before he could start it. The accused in the high profile Bhanwari case, investigated by the Central Bureau of Investigation, include the former Rajasthan Minister Mahipal Maderna and Congress MLA Malkhan Singh Bishnoi. Several cases, including those pertaining to land grabbing and narcotics smuggling are pending against the Kailash Jakhar-Bishnaram Bishnoi duo. Meanwhile, Chief Minister Ashok Gehlot after a high level review meeting constituted a committee to examine the larger issues arising out of the development and suggest remedial measures. The meeting was attended by Minister of State for Home Virendra Beniwal and Chief Secretary C.K. Mathew. The committee, headed by Additional Chief Secretary (Home) with the Director-General of Police and Director-General (Crime) as members and Additional Director-General (Crime) as member-secretary, has been asked to look into the procedure of taking under-trials to court and back. The committee will review the security of the courts and consider measures such as installation of closed-circuit cameras on the premises. Alternative arrangements such as use of video conferencing between jails and the judiciary and setting up courts within the jail premises would be considered by the committee. The committee has been asked to submit its report in 30 days.

    SCERT introduces text book lessons that promote gender equality

    The State Council of Educational Research and Training (SCERT) has introduced gender friendly lessons in its text books for Class I, VI and VII. Hoping to contain the girl child dropout rate in Class VII and removing the stereotypes from textbooks, SCERT has introduced lessons on gender equality. These include images showing a man helping his wife in the kitchen and in another picture, helping his young daughter get ready for school. In another text , the story of a girl child studying hard to eventually take up a job, are being told through illustrations in the form of a 'Burra Katha' (local folk tale). Sketches of bright-eyed young girls walking into junior colleges or sharing the stage with boys for a performance are the Andhra Pradesh government's first baby steps towards gender sensitive education. The story in the first language textbook of Class VII, 'Sita Istalalu', ends with the girl child enrolling into college and then becoming an officer, complete with a personal assistant as shown in the image. In another story, 'Meti Balika', a physically challenged girl child is shown performing on stage to the cheers of her classmates. "There is no gender bias in our textbooks anymore. In social studies we have introduced a chapter on gender disparities. These issues have been addressed in our lessons in all our books," says B Seshu Kumari, director, SCERT. This is the first time since the state of Andhra Pradesh was formed that a state curriculum is being developed locally. The state until 2008 was following the national curriculum that was in place, which too had remained unchanged since 1992-93.
